Please find below our General Terms and Conditions of Sale, which we advise you to read. These Terms & Conditions and the Privacy Policy govern the use of this site and set out the legal responsibilities and obligations that exist between Marelle Cosmétiques and you, the Customer, as a user of this site.

By placing an order for a product on our website www.marelle-bio.com, the Customer acknowledges having read these General Terms and Conditions of Sale and having accepted them without restriction.

1. Preamble

The present General Terms and Conditions of Sale apply to all orders placed on the www.marelle-bio.com website (hereinafter referred to as the “Site”).

These General Terms and Conditions of Sale are entered into between :

Marelle Cosmétiques Sàrl, headquartered at route de Gland 2, 1268 Begnins, Switzerland, registered with the Registre du Commerce du Canton de Vaud under number CHE-483.969.432 (hereinafter referred to as “Marelle”).

On the other hand,

Any individual or legal entity wishing to make a purchase via the www.marelle-bio.com website (hereinafter referred to as “the Customer”).

2. Object

The present General Terms and Conditions of Sale govern the contractual relationship between Marelle Cosmétiques and the Customer, in the context of the sale of products by Marelle Cosmétiques via its merchant site. Both parties unreservedly accept these General Terms and Conditions of Sale and they shall prevail over any other conditions appearing in any other document.

Marelle reserves the right to modify, at any time, the content and form of these General Terms and Conditions of Sale, which remain accessible at all times on the Site.

3. Products

The products offered for sale by Marelle are those shown on this Site, on the day the user consults the Site, and within the limits of available stocks. Marelle reserves the right to withdraw from sale, at any time and without notice, any product present on the Site and/or to replace or modify any information associated with the products appearing on this Site.

In the event that a product is unavailable after an order has been placed, the customer will be informed as soon as possible by email, and the order will then be automatically cancelled.

The photographs illustrating the products are intended to be as faithful as possible to the products sold, but are not contractually binding.

4. Orders

In order to order on this Site, the Customer must meet the following conditions:

Validation of the order by the Customer confirms acceptance of the GCS, the content of the order, its price and the associated charges.

All orders are subject to prior acceptance by Marelle and are only definitively confirmed once the Customer has received an order and shipping confirmation email.

Marelle reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order.

The information provided by the customer when placing an order is binding: in the event of an error in the recipient’s details, Marelle cannot be held responsible for the impossibility of delivering the product.

5. Prices

Prices are indicated on the Site in Swiss francs (CHF) for customers based in Switzerland, and in euros (€) for customers based in all other countries. These prices include all taxes (TTC) and notably take into account the VAT applicable on the day of the order for prices indicated in Swiss francs (CHF). Prices quoted in euros (€) are exclusive of VAT.

The prices shown do not include delivery charges (postage, packaging and preparation of the parcel according to the amounts in force). The amount of shipping costs is specified on the Site before the order is validated.

Marelle reserves the right to modify the price of its products at any time and without notice. However, these modifications will not affect orders accepted before the modifications come into effect, subject to the availability of the products ordered.

For sales outside Switzerland and the European Union, please note that customs clearance fees and the payment of various duties and taxes are the responsibility of the customer.

6. Payments

Payments are made immediately online by two methods:

Credit card (VISA, MasterCard) with fully secure payment via the STRIPE platform.

TWINT via the smartphone application for Swiss residents only.

Payment by credit card:

Marelle has no access to confidential payment information. The information entered is encrypted and transmitted to STRIPE securely, without Marelle or third parties having access to it.

STRIPE is a technical service provider, and does not take responsibility for order disputes. These must be settled directly with Marelle and/or your bank.

Payments by TWINT:

With TWINT, you can pay quickly and easily at no charge if you are resident in Switzerland only. The TWINT application can be linked directly to your account or you deposit a credit card, i.e. you load a credit onto the application to simply pay with your smartphone (Android or iOS).

7. Deliveries

Once payment has been received, the order will be processed as quickly as possible. We take great care in preparing our orders.

During trade shows or vacations, order preparation may take a little longer. In this case, you will be notified by email.

In-stock items are delivered to the address indicated by the customer at the time of ordering.

Customers are informed that it is their responsibility to provide the details necessary for the proper processing of their order (e.g. building access code). If the delivery address provided by the Customer is invalid, resulting in the return of the parcel due to non-receipt at the address indicated, the cost of resending the parcel to the new address will be borne by the Customer.

Depending on the size and weight of the goods, shipment will be made by post or via a carrier, within 2 to 10 working days.

Marelle declines all responsibility in the event of loss of ordered products or strikes by postal services or other carriers.

Damaged packaging must not be opened. In the event of defects or damage, the Customer must contact Customer Service on the day of receipt or, at the latest, on the first working day following receipt: contact@marelle-bio.com and immediately contact the post office to report the damaged parcel and obtain a report of deterioration or spoliation. The Customer must then forward this document to Marelle in order to initiate the procedure.

8. Shipping fees

Shipping costs are payable by the Customer and depend on the weight and volume of the order, the delivery address and the carrier.

The rate will be indicated to the customer before the order is validated.

8.1 Deliveries to Switzerland

Deliveries within Switzerland are sent by Swiss Post. After shipment, you will automatically receive a tracking number for your order.

8.2 European Union and International deliveries

For deliveries within the European Union and internationally, delivery charges vary according to destination and package weight.

Final charges are calculated at the end of the order process.

9. Exchanges and returns

If the products do not suit you, you have fifteen (15) days from receipt of your order to return them to us.

The cost of transporting the returned goods will be at your expense.

Products must be returned in their original packaging, in their original condition, including the intact tamper-evident rings on each product (aluminum seal on the tube of our Delicate hydrating cream and protective ring on the pump of our Ultra gentle cleansing gel and our Micellar floral water).

IMPORTANT: Marelle reserves the right to disregard the customer’s right of withdrawal for items returned unsealed, for health and safety reasons.

To make a return, the Customer must:

Once the return has been validated, you will receive the refund by the same means as payment in the case of a refund request.

Should the Customer fail to respect the present conditions, in particular the conditions of return or exchange, Marelle will not be able to proceed with the reimbursement of the products concerned.

10. Right of withdrawal

The customer has the right to cancel his order at any time within fifteen (15) calendar days of the date on which he received the products, without having to justify his decision or pay any penalties. After this period, the sale is considered firm and therefore definitive. If the customer wishes to exercise his/her right of withdrawal, he/she must contact customer service at contact@marelle-bio.com and follow the instructions detailed above. No returns will be accepted unless the department has been contacted beforehand and a return agreement has been formulated.

Once Marelle has accepted the return, the Customer must ship the item(s) within seven (7) calendar days of the acceptance date. The article must be returned to Marelle by the Customer in its original condition, presentation and packaging, new and complete, and by a means of delivery that ensures its protection and preserves its perfect condition. Items returned incomplete, spoiled, used, damaged or soiled by the Customer will not be accepted. Marelle reserves the right to disregard the customer’s right of withdrawal for items returned unsealed, for health and safety reasons. Items are returned at the customer’s expense and risk. Once the returned items have been checked, Marelle undertakes to reimburse the Customer for the sums paid for the order, as soon as possible and at the latest within thirty (30) calendar days of receipt of the return package.

11. Warranties

The products sold by Marelle comply with European regulation n°1223/2009 in force.

Marelle’s liability is systematically limited to the value of the product in question, at its date of sale, and without any possibility of recourse against the brand or company producing the product. Marelle’s liability and warranty are excluded in the event of defects resulting from the use of the product by the customer, and in particular from use that does not comply with the product’s intended use.

In accordance with the legal provisions in force, the Customer benefits from the legal guarantee against defects in conformity existing at the time of delivery and the legal guarantee against defects or hidden faults in the products sold. The Customer must notify the carrier and Marelle of any reservations regarding the products delivered. The Customer must notify Marelle without delay of any complaint concerning the products, in particular in the event of a defective, damaged, non-conforming product or apparent defect, by e-mail to the contact details shown on the Site, specifying the product(s) concerned, the nature and type of defect. It is the Customer’s responsibility to provide proof of the defect. Marelle may request one or more photos of the product. In the event of a return accepted by Marelle, notably in the event of a lack of conformity, the Customer will have the choice between reimbursement or replacement of the product by an equivalent product offered by Marelle.

12. Responsibility

Marelle cannot be held responsible in the event of a breach of contract resulting from an act of God or force majeure.

Likewise, Marelle cannot be held responsible for damages of any kind, whether material, immaterial or physical, which may result from the malfunction or misuse of the products sold. Marelle’s liability will, in any event, be limited to the amount of the order.

Marelle reserves the right to modify the information on the Site at any time and without notice.

Marelle undertakes to describe the products marketed on the Site as accurately as possible and to ensure that the information published on the Site is kept up to date as far as possible. However, Marelle cannot guarantee the accuracy, precision or exhaustiveness of the information made available to Customers on the Site. Marelle cannot be held responsible for any insubstantial differences between the photographs, texts and illustrations presenting the products on the Site and the products ordered.

13. Intellectual property

The www.marelle-bio.com website is protected by intellectual property law. Each of the elements that make it up, such as the brand, logo, graphics, photographs, images and texts, are the exclusive property of Marelle, the only company authorized to use copyright and intellectual property rights. Any unauthorized reproduction, copy or imitation is strictly prohibited.

14. Applicable rights

The relationship between Marelle and the Customer is governed by Swiss law.
